Real Estate Services is a national, agent-first real estate platform. We give experienced property practitioners the brand, systems, resources and support of a major agency while allowing them to run their own businesses and keep more of their commission.

This Website is an information and application platform. Its purpose is to explain who we are and what we offer, and to allow property practitioners to apply to join us. It is the entry point to our recruitment and onboarding process. It is not a property listings portal, and using this Site does not create any estate agency mandate, sale, lease, or property transaction between you and us.

Nothing on this Website is an offer of employment, an offer to appoint you as an agent, or a binding commercial offer of any kind. If you apply and we accept you, the commercial relationship between you and Real Estate Services will be governed by a separate written agreement, including our Estate Agent Terms of Service, and not by these Terms.

These Terms govern only your use of the Website itself.

In these Terms, unless the context indicates otherwise:

• “Applicant” means a person who submits, or begins to submit, an application to join Real Estate Services through the Website.
• “Agent” means a property practitioner who has been accepted onto the Real Estate Services platform under a separate written agreement.
• “Content” means all text, graphics, logos, images, video, calculators, tools, data, software and other material made available on or through the Website.
• “Platform” means the systems, tools, brand, applications (including the RES Agent App), resources and support that Real Estate Services makes available to its Agents under a separate written agreement.
• “PPRA” means the Property Practitioners Regulatory Authority established under the Property Practitioners Act 22 of 2019.
• “Services” means the services, information, tools, resources and functionality made available to you on or through the Website.
• “you” and “your” mean the person accessing or using the Website.

By accessing or using the Website, or by submitting an application or enquiry through it, you confirm that you have read, understood and agree to these Terms, and that you are legally able to enter into a binding agreement.

These Terms apply to all users of the Website, including guests, applicants, and registered users. If you use the Website on behalf of a business or another person, you confirm that you are authorised to accept these Terms on their behalf.

If you do not agree with any part of these Terms, your only remedy is to stop using the Website.

You may use the Website only if you are at least 18 years old and legally able to enter into a binding agreement. The Website is not intended for children, and we do not knowingly collect information from anyone under 18.

The application and onboarding parts of the Website are intended for property practitioners and prospective property practitioners in South Africa. Registration as a property practitioner with the PPRA, and holding a valid Fidelity Fund Certificate where required by law, is a matter for you and the PPRA. We may ask you to confirm your registration status as part of any application, but you remain responsible for your own compliance with the Property Practitioners Act 22 of 2019 and all other laws that apply to you.

The Website allows you to apply to join Real Estate Services and to answer questions that help us assess whether there is a fit. When you apply, you agree to the following.

• You will provide information that is true, current and complete, and you will keep it up to date.
• Submitting an application does not guarantee that you will be accepted. We may accept or decline any application at our discretion, and we are not obliged to give reasons.
• An application, a qualification result, a quiz outcome, or any indication of eligibility shown on the Website is not an offer, a promise, or a binding agreement. It is part of an assessment process only.
• If we decide to proceed with you, your relationship with Real Estate Services will be set out in a separate written agreement. That agreement, and not these Terms, will govern your commission, your package, your obligations and ours.
• You consent to us contacting you about your application and about the platform, by the means described in our Privacy Policy. You can opt out of marketing communications at any time.

You are responsible for any information you submit. Submitting false, misleading or fraudulent information may result in your application being declined and, where relevant, reported to the appropriate authority.

This Website describes commission structures, packages, tiers and benefits, and it includes tools such as a commission calculator and slider. Please read this section carefully, because it explains what those figures are and what they are not.

• All commission percentages, package details, benefits, and Rand figures shown on the Website, including anything produced by a calculator or slider, are illustrative and for general information only. They are estimates based on the inputs and assumptions used, and they are not a quote, an offer, or a guarantee of any amount you will earn or keep.
• Phrases such as “up to 100% commission” describe the range available across our packages. The actual commission split, fees and terms that would apply to you depend on the package you qualify for, the tier you select, the terms attached to that tier, and the separate written agreement you would sign if accepted.
• Your actual earnings depend on factors within your control and outside it, including the deals you conclude, market conditions, deductions, and your own effort. We do not promise or guarantee any level of income. Please read our Disclaimer, which forms part of these Terms.
• Statistics and claims on the Website, such as figures for total agent commissions or lead-generation rankings, are based on information we believe to be accurate at the time of publication. They describe past or aggregate performance and are not a prediction of your results.
• The full, binding commission and package terms are provided during the application process and in the written agreement. If anything on this Website appears to conflict with that agreement, the written agreement prevails.

You agree to use the Website lawfully and responsibly. You may not:

• use the Website for any unlawful, fraudulent or unauthorised purpose, or in breach of any law that applies to you;
• submit information that is false, misleading, or not your own to submit;
• copy, republish, sell, licence, or commercially exploit any part of the Website or its Content without our written permission;
• infringe our intellectual property rights or those of any other person;
• upload or transmit any virus, worm, or other harmful code, or otherwise attempt to damage, disable, overburden or impair the Website;
• attempt to gain unauthorised access to the Website, its servers, or any system or network connected to it, or interfere with any security feature;
• engage in data mining, scraping, harvesting, or any similar automated collection of data from the Website;
• use the Website to send unsolicited communications, or to collect other users’ personal information without their consent;
• post or transmit any material that is unlawful, defamatory, harassing, abusive, discriminatory, obscene, or that promotes any of these;
• impersonate any person, or misrepresent your identity or your affiliation with any person; or
• use the Website in any way that could harm Real Estate Services, its Agents, its users, or its reputation.

We may investigate any suspected breach of this section and may suspend or terminate your access to the Website, and take any other action available to us in law, without notice.

Some parts of the Website, such as an application portal or member area, may require you to register or to receive login details.

If you are given, or you choose, a username, password or other login credential, you must keep it confidential and must not share it with anyone. Your account is personal to you, and you are responsible for everything done under it.

You must notify us immediately at info@realestateservices.co.za if you become aware of any unauthorised use of your account or any breach of security. We may disable any login credential at any time if we reasonably believe you have breached these Terms or that security is at risk.

How we handle the personal information linked to your account is explained in our Privacy Policy.

All Content on the Website, and the Website itself, including its design, text, graphics, logos, trade marks, images, video, calculators, tools and software, and the compilation of all of it, is owned by or licensed to Real Estate Services and is protected by South African and international intellectual property laws.

The name “Real Estate Services”, the RES name and logo, and all related names, logos, product and service names, designs and slogans, are trade marks of Real Estate Services or its licensors. You may not use any of them without our prior written permission.

We grant you a limited, personal, non-exclusive, non-transferable and revocable licence to access and view the Website and its Content for the purpose of learning about Real Estate Services and applying to join. This licence does not allow you to copy, modify, distribute, publish, reverse engineer, create derivative works from, or commercially exploit any part of the Website or its Content.

The brand, templates, marketing material, systems and other resources that we make available to accepted Agents are licensed separately under the written agreement between us. Nothing on this Website, and nothing in these Terms, grants you any right to use those resources.

“Your Submissions” means any information, enquiry, comment, review, testimonial, idea or other material you send to us or post through the Website, other than your personal information, which is dealt with under our Privacy Policy.

You are responsible for Your Submissions, and you confirm that they are your own, are accurate, and do not infringe the rights of any other person or breach any law.

By making a Submission, you grant us a non-exclusive, royalty-free, transferable licence to use, copy, adapt, publish and display it in connection with our business, including our marketing, unless we agree otherwise in writing. Where a Submission identifies you, we will use it in line with our Privacy Policy. We are under no obligation to use, publish or keep any Submission, and we may remove any Submission at our discretion.

The Website may contain links to, or make use of, third-party websites, tools and services, including our bond origination partner, booking and calendar tools, analytics providers, and social media platforms.

These are provided for your convenience. We do not control them and are not responsible for their content, their availability, or their practices. A link or reference is not an endorsement. Your use of any third-party website or service is governed by that third party’s own terms and privacy policy, which you should read.

We are not liable for any loss or damage arising from your use of any third-party website or service.

Real Estate Services provides its Agents with a range of tools and resources, including the RES Agent App, listings and design tools, templates, brand resources, training and support.

Access to and use of those tools and resources is available only to accepted Agents, and is governed by the separate written agreement between us, together with any app store terms and any specific terms for a particular tool. These Website Terms do not grant you access to the RES Agent App or any Agent resource, and any description of them on this Website is for information only.

When you use the Website, send us an enquiry or application, or send us email or other electronic messages, you are communicating with us electronically, and you consent to receive communications from us electronically.

You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing, in line with the Electronic Communications and Transactions Act 25 of 2002. Where a signature is required, an electronic signature is valid and binding to the extent permitted by that Act.

An electronic communication between you and us does not, by itself, create any business relationship or contract beyond what is expressly agreed.

Your privacy matters to us. Our Privacy Policy explains how we collect, use, share and protect your personal information in line with the Protection of Personal Information Act 4 of 2013 (POPIA) and other applicable laws.

Your use of the Website is also subject to our Privacy Policy, which forms part of and is incorporated into these Terms. By using the Website, you agree to the terms of our Privacy Policy.

Your use of the Website is also subject to our Disclaimer, which forms part of and is incorporated into these Terms.

The Disclaimer explains, among other things, that the information on the Website is general and not professional advice, and that the commission figures, calculators, statistics and testimonials on the Website are illustrative and are not a guarantee of any result. Please read it carefully.

The Website and its Content are provided “as is” and “as available”. To the fullest extent permitted by law, we make no representations or warranties of any kind, express or implied, about the Website, its Content, or its Services, including their accuracy, completeness, reliability, availability, or fitness for a particular purpose.

We do not warrant that the Website will be uninterrupted, timely, secure or error-free, that defects will be corrected, or that the Website or the servers that make it available are free of viruses or other harmful components.

Nothing in these Terms excludes or limits any right you may have under the Consumer Protection Act 68 of 2008 or any other law that cannot lawfully be excluded or limited.

To the fullest extent permitted by law, Real Estate Services, its directors, employees, agents and service providers will not be liable for any indirect, incidental, special, punitive or consequential loss or damage, or for any loss of profit, revenue, savings, data, or goodwill, arising out of or in connection with your use of, or inability to use, the Website, its Content or its Services, even if we have been advised of the possibility of such loss or damage.

To the fullest extent permitted by law, our total liability to you for all claims arising out of or in connection with the Website, whether in contract, delict (including negligence) or otherwise, is limited to a nominal amount, given that the Website is provided to you free of charge.

Nothing in these Terms excludes or limits our liability for fraud, for death or personal injury caused by our negligence, or for any other liability that cannot lawfully be excluded or limited, including under the Consumer Protection Act 68 of 2008.

If you are dissatisfied with the Website or with these Terms, your sole and exclusive remedy is to stop using the Website.

You agree to indemnify and hold harmless Real Estate Services, its directors, employees, agents and service providers against any claim, loss, damage, cost or expense (including reasonable legal costs) arising out of or in connection with your breach of these Terms, your misuse of the Website, or your breach of any law or of any right of another person.

We may change, suspend, restrict or withdraw all or any part of the Website, and any Content or Service on it, at any time and without notice. We will not be liable if the Website is unavailable at any time or for any period.

We may also restrict access to some or all of the Website to users, including registered users, and we may change the packages, benefits, tools and information described on the Website at any time.

We may suspend or terminate your access to the Website at any time, at our discretion, including if we reasonably believe you have breached these Terms.

Any provision of these Terms that by its nature should survive termination, including the sections on intellectual property, submissions, disclaimers, limitation of liability, indemnity, dispute resolution and governing law, will continue to apply after your access ends.

If you have a concern or dispute relating to the Website or these Terms, please raise it with us first by emailing info@realestateservices.co.za, so that we have a fair opportunity to resolve it. We are committed to resolving concerns quickly and in good faith.

If a dispute is not resolved within a reasonable time, either party may refer it to confidential arbitration in South Africa, to be conducted by a single arbitrator appointed under the rules of the Arbitration Foundation of Southern Africa (AFSA). The arbitration will be held in English. This clause does not prevent either party from approaching a competent South African court for urgent or interim relief.

This section does not affect any right you may have to lodge a complaint with a relevant regulator, or to approach a court where the law gives you that right.

These Terms, and any dispute or matter arising out of or in connection with them or with your use of the Website, are governed by and interpreted in accordance with the laws of the Republic of South Africa.

Subject to the Dispute Resolution section above, you submit to the jurisdiction of the courts of the Republic of South Africa.

• Entire agreement. These Terms, together with our Privacy Policy and Disclaimer, are the entire agreement between you and us about your use of the Website, and replace any earlier terms.
• Severability. If any provision of these Terms is found to be unlawful, void or unenforceable, that provision is severed, and the remaining provisions continue in full force.
• No waiver. If we do not enforce a right or provision of these Terms, that is not a waiver of that right or provision.
• Assignment. You may not assign or transfer your rights or obligations under these Terms. We may assign or transfer ours, including if our business changes hands.
• Force majeure. We are not liable for any failure or delay in performing our obligations where the failure or delay is caused by something beyond our reasonable control.
• Headings. Section titles are for convenience only and do not affect the interpretation of these Terms.

We may update or replace these Terms from time to time to reflect changes to our business, the Website, or the law. The current version is always the one published on this page, and any change takes effect when it is posted.

It is your responsibility to check this page from time to time. Your continued use of the Website after a change means you accept the updated Terms.
